PART IV - PREHEARING REVIEW

SECTION A-ANALYST’S ASSESSMENT
l. Facts and Circumstances:

         a. Evidence of record shows that on 25 April 1997, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 7, AR 635-200, by reason of fraudulent entry, with an uncharacterized discharge. She was advised of her rights. The applicant waived legal counsel, was advised of the impact of the discharge action, and did not submit a statement in her own behalf. The unit commander subsequently recommended separation from the service, and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action. On 1 May 1997, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with service uncharacterized.

         b. On 6 May 1997, the applicant was discharged. At the time of discharge, the applicant had completed 27 days of active military service.

2. Legal/Regulatory Basis for Separation Action : Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 7, Section V, paragraph 7-17 establishes policy and prescribes procedures for separating members for fraudulent entry. Fraudulent entry is the procurement of an enlistment, reenlistment, or period of active service through any deliberate material misrepresentation, omission, or concealment of information which, if known and considered by the Army at the time of enlistment or reenlistment might have resulted in rejection. This includes all disqualifying information requiring a waiver.

(1) The issue is rejected. The Board carefully examined the applicant’s record of service during the period of enlistment under review. The evidence of record shows that the applicant, while in entry-level status, was properly discharged under the provisions of Chapter 7, AR 635-200, by reason of fraudulent entry with service uncharacterized. A soldier is in entry level status for the first 180 days of continuous active duty. The record indicates that the applicant was processed for fraudulent enlistment because, at time of enlistment, she failed to reveal that she had fines totaling more than $4,000.00 outstanding and due to civil authorities of the State of New York for parking violations. Further, the record indicates that the applicant, although given the opportunity, presented no statements on her own behalf. The Board determined that the record does not support the applicant’s contentions and the applicant has provided no independent corroborating evidence in support of her contentions. The Board, being convinced that the reason for discharge and the characterization of service were both proper and equitable, voted to deny relief .

         b. Equity:       The applicant has not submitted an issue of equity and the ADRB has not otherwise relied upon an issue of equity to change the discharge. The major factors upon which the discharge was based are set forth in Parts III and IV of this decisional document.
